Travis:
That S–Corp declaration needs to be filed at
the same time as your corporation or can you file that at any time?
Jake:
You file that after. You have 75 days after the formation of the corporation to file that document.
Travis:
OK. I assume that is something that LegalZoom will handle for you if you want to file an S–Corp., correct?
Jake:
Yes, if you want us to file the S–Corp. obtainment, we can definitely
file that for you. We know what the IRS requires. We also know to where
it needs to be sent. Because depending on where you are in the country
it gets sent to a different location.
Travis:
Oh, wow.
Jake:
So you've got to make sure it gets sent to the right location. We
usually send everything via return receipt so we know that the IRS gets
it. Then if they ever say that they didn't you have proof that yes,
they signed for it. So that backs up your claim that you did receive it
and it should be considered as an S–Corporation.
