How can I get my LLC if I already have a DBA? Will I be assured of the same name?
Jake:
That's not necessarily the case. In some states, anyone can file for
that DBA. We would have to do a name check, search the state database
and figure out if that name is available. If it doesn't conflict or
cause confusion with any other name that someone else has under the
LLC, then you can go ahead and file the LLC. If you really want that
name, what you would do was then re–file a DBA under the LLC, saying
that the LLC is going to do business as that new name.
Travis:
Great, so if you already own a DBA and then you form an LLC, do you need to re–file your DBA under that LLC name?
Jake:
Yes you do.
Travis:
OK. So basically, that's how you would handle that situation. File an
LLC. It doesn't matter if you get the same name or not, because you
could file another DBA that has whatever name you want.
Jake:
Right.
